Welcome to Pulse 360º. These Terms & Conditions (“Terms”) govern your use of our website at pulse-360.myshopify.com and the purchase of products and services from us. By accessing our website or placing an order, you agree to be bound by these Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including but not limited to:

  • The Consumer Protection Act (CPA) No. 68 of 2008
  • The Electronic Communications and Transactions Act (ECTA) No. 25 of 2002
  • The Protection of Personal Information Act (POPIA) No. 4 of 2013
  • The Medicines and Related Substances Act No. 101 of 1965

Pulse 360º is a health and wellness business registered and operating in South Africa.

2. Acceptance of Terms

By using this website, you confirm that you are at least 18 years of age, or are accessing the site under the supervision of a parent or legal guardian. If you do not agree to these Terms, please do not use our website or purchase our products.

3. Products & Services

Pulse 360º offers physical health supplements, skincare products, and digital wellness programs. All products are subject to availability. We reserve the right to discontinue any product at any time without notice.

Product images are for illustrative purposes only and may differ slightly from the actual product. We make every effort to display colours and details accurately, but we cannot guarantee that your device’s display will be accurate.

4. Pricing & Payment

All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of checkout.

We accept payment via the methods available at checkout. Payment must be received in full before your order is processed or dispatched. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.

5. Orders & Contract Formation

In accordance with ECTA Section 22, an agreement of sale is concluded when we send you an order confirmation email. Placing an order constitutes an offer to purchase — we reserve the right to accept or decline any order.

We will send you an order confirmation email upon receipt of your order. This confirmation does not constitute acceptance of your order. Acceptance occurs when we dispatch your order or grant access to a digital product.

6. Consumer Rights (CPA)

As a consumer in South Africa, you are protected by the Consumer Protection Act No. 68 of 2008. Your rights include, but are not limited to:

  • The right to fair, honest, and reasonable dealing (Section 48)
  • The right to good-quality goods (Section 55)
  • The right to return defective goods within 6 months (Section 56)
  • The right to a cooling-off period of 5 business days for direct marketing purchases (Section 16)
  • The right to disclosure of information in plain and understandable language (Section 22)

Nothing in these Terms limits or excludes your rights under the CPA.

9. Digital Products

Access to digital wellness programs is granted upon confirmation of payment. By purchasing a digital product, you consent to immediate access and acknowledge that your right to cancel under Section 44 of ECTA may not apply once access has been granted. 10. Intellectual Property

All content on this website, including text, images, logos, program materials, and branding, is the intellectual property of Pulse 360º and is protected under South African copyright law. You may not reproduce, distribute, or use any content without our prior written consent.

11. Health Disclaimer

Please refer to our Health & SAHPRA Disclaimer, which forms part of these Terms. Our products are not intended to diagnose, treat, cure, or prevent any disease.

12. Limitation of Liability

To the maximum extent permitted by South African law, Pulse 360º shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our total liability to you shall not exceed the amount paid for the product giving rise to the claim.

This limitation does not apply where prohibited by the CPA or any other applicable South African legislation.

13. Protection of Personal Information (POPIA)

We are committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA) No. 4 of 2013. Please refer to our Privacy Policy for details on how we collect, use, store, and protect your personal data.

15. Governing Law & Disputes

You may also refer disputes to the National Consumer Commission (NCC) at www.thencc.gov.za or the relevant consumer tribunal.
